Comes J. Claxton, defendant
in the above entitled and
numbered cause and
excepting to the
Plaintiff's pleading filed
herein and says the same is
insufficient in law to
entitle the Plaintiff to
recover, and of this he
prays the judgment of the
Court;
     Specially excepting
herein the said defendant
says it appears from said
pleadings that this
defendant is im-properly
joined, as defendant, with
the Cameron Compress
Company, because it appears
from said pleadings that
there is no privity of
contract between this
defendant and said Cameron
Compress Company and it
appears from said pleadings
that this defendant is in
no way jointly liable to
the Plaintiff with said
Cameron Compress Company
and of this he prays the
judgment of the Court;
  
For answer herein this defendant denies all and singular the allegations of said
pleading and says he is not guilty of the injuries, wrongs and respasses therin
complained of, and of this he puts himself upon the Country.

if found in your County, to be and appear before me, the
undersigned, a Justice of the Peace in and for Precinct
No. 1, Milam County, at my office in Cameron on the 28 day
of Feby, 1898 at 10 o'clock AM., then and there to testify
in behalf of Plaintiff in a case now pending before me,
wherein P. C. Negroponte Plaintiff, and J. C. Claxton
Defendant, and there remain from day to day, and from term
to term, until duly discharged.
